Google’s free tools are powerful resources for family history buffs.  Here are the latest updates:

Google Takes on Facebook
Genealogists everywhere have been flocking to Facebook to make connections, share family tree info, and tap into the collective brain trust. (“Like” The Genealogy Gems Podcast on Facebook) Will they now flock to the new Google+ ? Only time will tell. I suspect that there’s a good possibility because Google+ is addressing privacy and sharing issues that Facebook just hasn’t mastered to everyone’s full satisfaction.

I love the easy to create “Circles” that allow you to share info just with certain groups of friends. And the bonus of this feature is that it cuts down on tons of info showing up in your “News Feed” (as it’s called in Facebook) that really doesn’t pertain to you and that you likely have no interest in.

Right now Google+ is by invitation only. But don’t worry – you’ll like receive an invite from someone you know, and in the end (after they work out more of the bugs) it will be open to everyone. Here’s a super quick video that explains the Google+ concept:

Was This My Ancestor’s Neighborhood? Using Google Earth for Genealogy

When Lisa blogged recently about Google Earth’s 10th birthday, it reminded me of something on my family history “to do” list. A few years ago I found a postcard of what I thought was an ancestor’s neighborhood. Could Google Earth confirm it?

Lisa uses Google Earth’s powerful 3D renderings of the world’s streets to identify where old pictures were taken. I knew from deeds, a plat map, and addresses on censuses and draft registrations that the O’Hotnicky lived on a certain block of Jones St. (now named Grant St.), around the corner from and behind Holy Ghost church.

Olyphant view Google EarthI opened Google Earth and flew to “117 Grant St, Olyphant, PA.” The initial view, hovering from above, was promising. The camera icon shows where I thought the photo was taken. The left arrow points to the former line of trees, in front of the ancestral address. The right arrow points to the church tower behind.

Unfortunately, when I enter Street View at that exact spot, the new church on the corner and a tall apartment building block the view that would have been seen a century ago. There is no Street View available on Grant Street itself so I couldn’t move up the street toward the church. So I moved into Street View along the side street (parallel to the bottom of the photo).

In the opening between two buildings, Google Earth gave me a glimpse of the church tower. I compared the postcard view with Google Earth’s photo. The church towers look so similar: a simple cross on top, pointed copper roof, arched tower and the building roof line. Even more striking to me is the white frame house. These two visuals taken together–the church tower profile and the position of the white house–seem consistent with my theory of where the photo was taken. Which means that yes, indeed, this 1910 postcard shows the trees in front of an ancestor’s home as they appeared 105 years ago.

Genealogy Research Techniques for Finding Your Free People of Color

Not all people of color were enslaved prior to the emancipation. In fact, many were freed long before that. Researching free people of color can be quite complex. Tracing my own family line (who were free people of color) continues to be a real learning process for me. However, don’t let the challenges deter you from exploring this rich part of your heritage. In this “Getting Started” post, we discuss the manumission process, “negro registers,” and more for tracing your free people of color.

Who are Free People of Color?

[Note: Throughout our post, we will be using terminology that was used at the time the records were created.] A ‘free negro’ or ‘free black’ was a fairly recent status in the U.S. which differentiated between an African-American person who was free and those who were enslaved prior to emancipation. If a person was referred to as a ‘free negro’ or ‘free black’, that meant the person was not living in slavery. It is a fascinating and little know fact that, as Ancestry Wiki states, “one in ten African-Americans was already free when the first shots were fired on Fort Sumter.”

Step 1 for Tracing Free People of Color: Censuses

Sometimes, the story of your ancestors being free people of color was passed on through oral traditions. In my own family, our “line of color” was not talked about. Instead, my first clue was when I found my ancestor in the 1840 population census listed as free. I also found that one woman (presumably his wife) was marked in the column for “free white persons,” but John and the children were marked as “free colored persons” in this census. This was the first step to identifying my ancestor as a free person of color.

Let’s see another example. The 1850 and 1860 U.S. Federal Censuses included two population schedules. One enumerated free inhabitants, and the additional schedule, referred to as a Slave Schedule, was for making an enumeration of those persons who were enslaved. [We will discuss this further, below.]

If your ancestor appears on the 1850 U.S. Federal Census for free inhabitants, they are considered free, even if their race was listed as “Black.” An example of a Black man enumerated on the 1850 census is shown in the image below. Archibald Giles is recorded as “Black,” but appears on this census for “free inhabitants.” Therefore, he would be considered a free person of color.

If your targeted ancestor does not appear on either the 1850 or 1860 population schedule for free inhabitants, they might have been enumerated on the slave schedules of 1850 or 1860.

You can check the 1850 Slave Schedule and the 1860 Slave Schedules at Ancestry.com. The 1850 census is also available at Findmypast, MyHeritage, and FamilySearch.

In this example to the left, you will see a portion of the Henry County, Tennessee Slave Schedule for 1850. Notice, only the heads of household or the “owners” were listed by name. Slaves were not named, but rather listed by age and sex under the names of their “owners.”

Step 2: The Manumission Process

Once you have identified that you have free people of color in your family tree, the next step is to determine how they became free. Many free people of color came from families that had been free for generations. This could have been due to a manumission of an ancestor or a relationship between an indentured white woman and a black slave. I make mention of this relationship between races because it is helpful to remember that the status (whether free or enslaved) of the child was based on the status of their mother. If the mother was free, then the child was free. If she was a slave, then the child was enslaved. [1]

Manumission was a formal way in which slaves were set free. There are many reasons why a slave owner may have released or freed his slaves. In some cases, slave owners would free their mistresses and children born to her. In one case, I found the following comment made by the slave owner,  “I give my slaves their freedom, to which my conscience tells me they are justly entitled. It has a long time been a matter of the deepest regret to me…” And thirdly, it was possible for a slave to obtain their manumission through the act of “self-purchase.”

If the mother was free, then the child was free. If she was a slave, then the child was enslaved. [1]

Private manumission through probate. A private manumission decree could be made in a last will and testament. You can find these manumissions in wills, estate papers, or in probate packets. Many of these county level probate records have been microfilmed or digitized and are easily accessible online.

Sometimes, a manumission in a will would be contested. When this happened, a long paper trail of court documents may have been created. A thorough search of all of these proceedings may offer a wealth of genealogical data and clues.

Usually, manumission papers included the name of the slave owner, the name of the slave, and the reason for manumission. In the case of the slaves of John Randolph of Roanoke [Virginia,] his slaves were not named individually in his will written on 4 May 1819. Instead he stated, “I give my slaves their freedom, to which my conscience tells me they are justly entitled. It has a long time been a matter of the deepest regret to me, that the circumstances under which I inherited them, and the obstacles thrown in the way by the laws of the land, have prevented my manumitting them in my lifetime, which is my full intention to do, in case I can accomplish it.”[2]

John freed over five hundred slaves, and though each of them was not listed by name in his will, a codicil at the end of the will did name two of his slaves when he asked that Essex and his wife Hetty “be made quite comfortable.”[3]

Manumission through self purchase. Self-purchase may seem impossible; however, many slaves were not required to work on Sundays for their masters.[4] On this day, men and women could hire themselves out to do work for others. With frugality, they could save their earnings to buy their freedom or the freedom of their loved ones, though this was very, very difficult.

As you can see in this example of Arthur Lee, he was able to pay for his freedom and the freedom of his wife, though it took many years. This type of record could be found in a published book, a record listed in notarial books of the county, civil minutes books, or other courthouse holdings. It is important to speak with a knowledgeable person in your targeted area about where you should look. A knowledgeable person may be those working with the local historical or genealogical society, or a head of the local history department of the public library.

Step 3: “Negro Registers”

If you do not find the manumission in a last will and testament, perhaps due to a courthouse fire or other loss, you may have luck searching the county records where your free people of color later settled. Free people of color were often required to register, using their freedom papers, when they relocated to a new area. These types of records are called ‘negro registers’ or ‘records of free negros.’

Newly freed people carried with them their freedom papers which were given to them when they were manumitted. Once they relocated, they would register with the county clerk. They would need to show the county clerk these freedom papers and a record was made in the register. The record may include the name of members of the family, ages, and most recent place of residence.

The book titled Registers of Blacks in the Miami Valley: A Name Abstract, 1804-1857 by Stephen Haller and Robert Smith, Jr. provides the following information about registers of freed people:

“From 1804 to 1857, black people in Ohio had to register their freedom papers with the clerk of courts of common pleas in the county where they desired residency or employment. State law required this registration, and clerks of court were to keep register books containing a transcript of each freedom certificate or other written proof of freedom (see Laws of Ohio 1804, page 63-66; 1833, page 22; 1857, page 186). Few of these registers have survived to the 20th century.”[2]

Though this author says that only a few of the registers have survived, I found some microfilmed registers listing the names of free people of color who had settled in Miami County, Ohio at the local historical society archives. Again, it is important to ask those people who would be most knowledgeable, and in this case, it was the historical society.

In conclusion, we understand that tracing both our enslaved and manumitted ancestors is often a difficult task. We also know there is much more to learn and share for the best techniques to researching these lines. We encourage you to review some of the additional sources below. Episode 37: Your Genealogy Questions Answered, Part 2

Question: Is there a way to get iTunes to download all of the podcasts instead of just the most recent ones? I thought I saw it on the website somewhere but now I can’t find it. –Melanie Armstrong

Answer: (updated since the podcast originally aired): In your iTunes LIBRARY, on the line where the Genealogy Gems Podcast is listed click the GET ALL button. This will download all the past episodes to iTunes on your computer, to be listened to at your convenience. Downloading will take several minutes.  You will see a little spinning orange circle to the left of the podcast name as it downloads.  Once the episode is downloaded the text will turn from gray to black.  Double click the episode and it will start to play after a moment or two.

Question: I use the free forms at Family Tree Magazine’s website. Do you keep your old Family Group Sheets on file so you can double check them later? – R. Butler

Answer: I love all those free forms at Family Tree Magazine! I’ll tell you the truth, I decided to throw mine away. I transcribed everything into my database and threw away the paper. Everything is properly sourced there, which is key. I avoid duplicating efforts, which has happened to me when looking back at old paper forms. If I need to double-check things, I do it from the actual sources—the birth or death certificate or interview—not from the family group sheet. The only exception is if the group sheet is part of a brick wall case file that I haven’t solved yet. I keep them until the case is solved, and then the cited answers go into the database.

Question: How do you know when records/indices are complete? I have been looking for immigration records for my family and cannot find them.

They came in large family groups, so you would think it would be easy to find. Even though the name (Mauge) is often misspelled (Mange, Mauga) I cannot find them at Ellis Island, Steve Morse’s website, The National Archives or through my Ancestry.com subscription. The years span 1880 through 1885. Are these immigration records complete or am I looking in the wrong place? -Anne-Marie Eischen

Answer: There are many factors involved here, and many avenues to pursue. Based on other information you told me about your family’s arrival, here are some ideas:

  • The Family History Library has microfilm of the Baltimore Passenger lists between 1920 and 1897 – and it lists the main author as the U.S. Dept of the Treasury, Bureau of Customs. Passengers are indexed by soundex and the soundex code for Mauge would be M200.  But considering the variations you have found of the name you’ll want to arm yourself with the soundex codes for all those variations. The M200 names are on Film # 417302 which I found in the Family History Library catalog and familysearch.org and you can just go to your closes Family History Center and order the film for under $10 and they will send it to you to view at the center.
  • Check the at the Immigrant’s Ships Transcribers Guild website.
  • Click here for a great summary of Baltimore passenger lists by Joe Beine online.
  • You will also find an index for Baltimore passenger lists between 1820 and 1897 at the Allen County Public Library in Fort Wayne, IN.
  • Look closely at your source for the port information, and see if you can locate any other verification of that. Maybe she actually arrived through another port.
  • Usually I would tell you to check departure lists, but in this case, departure lists for Bremen for that time period are not available.

Question: I wanted to share the results of my Google Alerts. My father had red hair and was called “Red” most of his life. So when I ask for “Red” Browning in my alerts, I have received information on the red Browning sweater (the Browning clothing line), a red Browning rifle case (they make guns) and recently the Cincinnati Reds Tom Browning went to jail (the Red’s Browning…). Alas, nothing yet on my Dad! Another family name is Gorry – you can imagine what I got last Halloween! I do love the alerts though – and have added eBay alerts too, thanks to you. Answer: I’m not sure how much I can help with that one – keep playing with the “plus” and “minus” signs in your searches to refine what you’re looking for. Question: This is just something that bugs me. WHICH is the correct pronunciation of Genealogy??? GEEN-e-alogy (with a long “e” at the beginning) or Gen-e-ology (with a short “e” at the beginning)?

Answer: I’ve heard it both ways and I’ve pronounced it both ways. But when I went to Dictionary.com, they actually have an audio pronunciation and they say, GEEN-e-alogy, with a long “e” at the beginning. However you pronounce it, it’s a barrel of fun!

But knowing which records are available and where to find them can sound daunting, and that stops many genealogists from ever tapping into them. In this episode our aim is to fix all that. Where are Federal Records Found?

Federal Court Records are initially held in the custody of the national federal courthouses where the events occurred.

The National Archives and Records Administration (NARA) was founded in 1934.

Regional Archives – about a dozen across the country – hold record geographically by area. View the locations here at the National Archives website.

Are all the records catalogued on the National Archives website?

  • Master federal indexes are not yet online. Indexes are found at the location/level where these record files were created.
  • Each of the federal courts are found in record groups (RG).
  • Get the finding aid for the record group online at the National Archives website. That will point in the right direction as to where to get the indices.
  • Resource: Finding Aids at the National Archives

Types of Federal Courts:

The Federal Court System of the United States was established under the Judiciary Act of 1789 (1 Stat. 76) on September 24, 1789. Click here to read more about the role and structure of the federal courts at the United States Courts website.

District Courts:

Trial Courts of the United States. Their jurisdiction include:

  • Admiralty
  • Equity
  • Bankruptcy
  • and Naturalization

These courts began at different times dependent on the geographic area and when the states were created.

Circuit Courts:

Originally established in 1789 as three courts and later expanded to nine courts by 1866. Circuit Courts have jurisdiction over all matters (especially criminal) covered by Federal Law. Abolished in 1911 and taken over by District Courts.

Circuit Courts of Appeals:

Established under the Federal Court System by an Act of Congress on March 3, 1891 (26 Stat. 826), by acquiring the appellate jurisdiction of the U.S. Circuit Courts and later the U.S. District Courts. They have different geographic jurisdictions than the regular federal courts.

Supreme Court:

It is recognized as the highest court in the United States operating as an appeals court. Although a criminal case may have first been heard at the local level, it may have escalated to a federal court. Therefore, there could be federal records on that case.

Application for the Genealogist:

Michael has found that some of the richest records in the federal court system have come from the criminal court records. Our ancestors did get into trouble upon occasion. Michael’s grandfather was arrested in the 1940s and he was able to obtain those records.

Searching for Federal Records

Is it worthwhile to head to the National Archives and generally search to see if an ancestor has records? Or is it best to identify a case first, perhaps through a newspaper article, and then go to the National Archives location that would have the records for those identified cases?

No one is wasting their time going and searching the records. It’s a great way to get familiar with them. However, identifying a case through other records first can lead you quickly to the federal records. (Michael first found his grandfather’s case in a newspaper article.)

Types of Federal Court Records:

Dockets: Lists of cases heard by the court. Sometime referred to as court calendars.

Minutes:

Brief daily accounts of all actions taken by the court.

Orders:

The specific judgments or orders of the court. An example would be an order granting citizenship.

Briefs:

Legal document arguing why one Party should prevail on a case.

Mandates:

When a Defendant obligates themselves to engage in activities in exchange for suspension of sentence. Frequently seen in Criminal Court.

Case Files:

All the loose documents relating to the case bundled together.

How to Find Records at the Archives:

  1. Review the finding aid
  2. Request the Index and find the name and corresponding file information
  3. Request the record

An appointment is not required. They will pull the records as you request them. Record groups are pulled at different times. For the most part you will have the opportunity to view the original documents.

Record Groups:

The National Archives is set up by record groups, such as:

Records of the U.S. District Court – RG 21

Records of the U.S. Supreme Court – RG 267

Records of the U.S. Court of Appeals – RG 276

Records of the U.S. Court of Claims – RG 123  (Claims against the US. Individual citizens could actually file claims against the US)

Request the individual record groups separately.

Bankruptcy:

Bankruptcy Acts were passed by Congress usually after business disturbances or financial recessions.

Bankruptcy Act of 1800

This act followed the business disturbances of 1797.

The first national bankruptcy act was approved on April 4, 1800 (2 Stat, 19.) It provided for an effective period beginning June 2, 1800 and continuing for 5 years.

It applied only to merchants or other related parties. The act provided for compulsory or involuntary bankruptcy, but not for voluntary bankruptcy. Because of its limited applicability the act was repealed on December 19, 1803, just months before its expiration date.

Bankruptcy Act of 1841

This act followed the business panic of 1837.

The second national bankruptcy act was passed on August 19, 1841 and was to take effect on February 1, 1842.

The law allowed voluntary bankruptcy to all debtors, but limited involuntary bankruptcy to merchants, bankers, factors (an agent or commissioned merchant), brokers, and traders.

It eliminated the requirement of the consent of the creditor for a discharge. The bankrupt filer, however, could obtain his discharge through a jury trial if the jury found that he had surrendered all his property and had fully complied with the orders of the court.

Bankruptcy Act of 1867

This act followed the post-Civil War recession of 1866-1867.

On March 2, 1867, Congress approved the Nation’s third bankruptcy act to assist the judges in the administration of the law, the act provided for the appointment by the court of registers in bankruptcy.

The registers were authorized to make adjudications of bankruptcy, to hold and preside at meetings of creditors, to take proofs of debts, to make computations of dividends, and otherwise to dispatch the administrative business of the court in bankruptcy matters when there was no opposing interest.

In cases where opposition to an adjudication or a discharge arose, the controversy was to be submitted to the court.

Bankruptcy Act of 1898

This act followed the business panic of 1893 and the depression that followed. We are currently under the umbrella of this fourth act.

In 1889 The National Convention of Representatives of Commercial Bodies was formed to lobby for bankruptcy legislation. The president of the Convention, Jay L. Torrey, drafted a new Bankruptcy Bill otherwise known as the “Torrey Bill.”

In 1898 Congress passed a bankruptcy bill based on the previous Torrey bill. This Act also called the “Nelson Act” was passed July 1, 1898, (Ch. 541, 30 Stat. 544.) It was the first United States Act of Congress involving Bankruptcy that gave companies an option of being protected from creditors. Previous attempts at bankruptcy law had lasted at most a few years. Its popular name is a homage to the role of Senator Knute Nelson of Minnesota.

Bankruptcy files are in the custody of the National Archives and now stored offsite at the National Archives branch in Kansas City, MO. Researchers should contact the Archives directly to conduct searches. Some indexes are still maintained at the regional archives.

May 18, 1867 (Page 3, Column 6), in the Berks & Schuylkill Journal newspaper the entry reads: “P.L. Strauss of Bethel Twp. Berks County, PA Class #13 License paid $10.00 to conduct store (merchant).” 

This is the business he had at the time of his bankruptcy filing on May 27, 1867 in Philadelphia, PA in the Eastern District of Pennsylvania.

Types of Information Found in Bankruptcy Records:

  • Lists of creditors (name, address)
  • Amount of money owed (the debt)
  • Specific information about the items for which the debt was incurred
  • Total dollar amounts

Follow the Federal Record Trail:

Information found could lead you to additional records. For example, if your ancestor filed for bankruptcy due to debts associated with his business, you could go back to the local level to look for records such as a business license, newspaper articles, etc.

Lisa suggests searching Google Books for digitized items such as county histories, almanacs, catalogs, merchant association books, etc. Here’s an example of a bankruptcy notice found in Google Books (which is free) for Michael’s ancestor Percival L. Strauss

Bankruptcy notice (Oct. 9, 1868) found in Google Books

The National Archives has been consolidating all of the bankruptcy records. It is going to be the Kansas City, MO branch of the National Archives, which currently has the Patent files.

Examples of bankruptcy cases:

  • Bankruptcy Act of 1841 – Edgar Allen Poe filed bankruptcy in 1841.
  • Bankruptcy Act of 1898 Act – Dean Martin in New York

Amendments to the most recent bankruptcy act include:

1933: The “1898 Bankruptcy Act”

Amended to include railroad reorganization, corporate reorganization, and individual debtor arrangements.

1938:  The “Chandler Act”

Amended the earlier 1898 Bankruptcy Act, creating a menu of options for both business and non-business debtors. Named for Walter Chandler.

1978: The 1898 Bankruptcy Act

Replaced by The Bankruptcy Reform Act. This Act is still used today.

Writs of Habeas Corpus:

Habeas corpus is a court order from a judge instructing a person who is detaining another to bring the detainee before the court for a specific purpose.

It was often used during the Civil War for soldiers under the age of 18 years and in reference to runaway slaves.

Writs can be found in most case files. They usually involves a petition, transcript, order, and the writ when ordered by the Judge. Contact the National Archives regarding RG19 for records pertaining to this set of documents and indexes.

Fugitive Slave Act:

The Fugitive Slave Act of 1850 was passed by the United States Congress on September 18, 1850 as part of the Compromise of 1850. It was one of the controversial acts passed down by law. Runaway slaves could be returned with the help of the Federal Government.

Records can include:

  • Petitions
  • Affidavits
  • Testimonies
  • Documentation of ownership

Records are typically found in the court of original petition and the court with jurisdiction over the area where the slave escaped. Search under the slave holder’s name.

The Confiscation Act of 1862:

Passed by an act of Congress on July 17, 1862, the full title is “An Act to Suppress Insurrection, to Punish Treason and Rebellion, to Seize and Confiscate the Property of Rebels, and for Other Purposes.”

This Act gave the power to take the land and businesses of persons who served the Confederacy. Records include case files include; petitions, orders of the court, proofs of public notice, and notices of seizure

Example: General Robert E. Lee. The act covered land under Union Control. Lee lived in Northern Virginia, and his home was confiscated. The file has a complete inventory of his house. The location is now the Arlington National Cemetery.

Federal Criminal Records

Criminal records could include cases covering:

  • Treason
  • Assault and Battery on the high seas
  • Conspiracy to over through our government
  • Smuggling
  • Forgery
  • Counterfeiting
  • Carrying on a business without a license
  • Not paying taxes

Naturalization Records:

Records were created:

  1. at the federal level
  2. at the local level – local court at the county level

1790: The first national act created a two-step process:

  1. Declare your intention to become a citizen
  2. File your petition for citizenship

Your ancestors may not have finished the process, and they may have filed both at local and federal levels.
